1.You must have read, understood and accepted these conditions before
using Joe’s Jukebox ®.
2.The following conditions apply specifically to you if you want
samples from your own CD to be played on Joe’s Jukebox ®:

YOU WANT TO SUBMIT YOUR CD FOR SAMPLES TO BE PLAYED ON JOE’S JUKEBOX DO
NOT SUBMIT ANY PAYMENT BEFORE CONDITIONS 5, 6, 7, 8 and 9 BELOW HAVE
BEEN FULLY SATISFIED.
4.IF YOU MAKE PAYMENT BEFORE THE
WEMASTER HAS ADVISED YOU THAT CONDITIONS 5, 6, 7, 8 AND 9 HAVE BEEN
FULLY SATISFIED, YOU DO SO AT YOUR OWN RISK AND THE SOCIETY WILL NOT
MAKE ANY REFUND TO YOU. IF YOUR CD IS SUBSEQUENTLY VALIDATED BY THE
SOCIETY FOR INCLUSION ON JOE’S JUKEBOX ® IN ACCORDANCE WITH CONDITIONS
5, 6, 7, 8 AND 9 YOU MAY THEN BE ASKED TO MAKE A PAYMENT IN ACCORDANCE
WITH THE SOCIETY’S THEN CURRENT PAYMENTS’ TARIFF AND ANY PAYMENT YOU
MADE EARLIER WILL NOT BE TAKEN INTO ACCOUNT.
5.To make a
request for your CD to be featured on Joe’s Jukebox ® please submit a
request to the Society’s webmaster using the form below,
together with such details as the webmaster requires from you when he
responds to you, including but not limited to the details required in
condition 7 below. If for any reason you have not had a reply from the
webmaster within seven working days please email the webmaster
directly: joemeeksociety+jukebox@gmail.com
6.The
webmaster will then ask you to send two copies of the CD
(non-returnable) to the address(es) he advises, so that the Society can
listen to and evaluate the content of the CD.
7.THE SOCIETY
WILL ONLY AGREE TO THE USE OF YOUR CD ON JOE’S JUKEBOX ® IF IT IS LEGAL
AND THE MUSIC ON IT HAS BEEN LICENSED BY MCPRS (MECHANICAL COPYRIGHT
PERFORMING RIGHTS SOCIETY) AND YOU CAN PRODUCE EVIDENCE OF THIS TO THE
SOCIETY IN THE FORM OF THE LICENCE NUMBER AND ANY SUCH OTHER DETAILS OF
THE LICENCE AS THE SOCIETY SHALL REQUIRE.
8.PLEASE ALSO NOTE
THAT THE SOCIETY WILL NOT ACCEPT MATERIAL THAT IS IN THE SOCIETY’S
OPINION POOR OR OF DUBIOUS QUALITY OR DOWNRIGHT ABUSIVE.
9.If
the Society is happy with the content, legality and the licensing
arrangements for the CD and you have satisfied any of the webmaster’s
other requirements satisfactorily the webmaster will write to you
accepting samples from the CD for inclusion on Joe’s Jukebox ®.
10.Once
all the above conditions have been satisfied please note that the
Society will play samples of up to eight tracks from the CD on Joe’s
Jukebox ® so when the webmaster writes to you in accordance with
condition 9, you will need to email the webmaster to tell him exactly
which tracks you wish to be put on to Joe’s Jukebox ®. The sample
tracks will be up to 50 seconds long.
11.At this stage
you may be asked to pay a fee in accordance with the Society’s then
current tariff by either cheque or by PayPal.
12.Once payment
has been accepted and cleared by the Society the samples from your CD
that you have specified in writing to the webmaster will be put on
Joe’s Jukebox ® for a period of up to four weeks when the CD samples
will taken down from the site.
13.In submitting samples from your CD for inclusion on Joe’s
Jukebox ® please be aware that in doing so you will then be legally
responsible for indemnifying the Society against any losses claims
damages or expenses of whatsoever nature in respect of the inclusion of
the samples of the CD on Joe’s Jukebox ®.
14.The Society does
not warrant or guarantee that Joe’s Jukebox ® will be working at all
times or at any time and/or is fit for any particular purpose.
15.The
Society shall not be liable to you in contract or tort in relation to
your use of Joe’s Jukebox ® or in any relation to any other matters
relating to its use. The Society’s total liability to you in contract
or tort (except for death or personal injury where the Society has been
negligent) is limited to any payment you have made to the Society for
inclusion of samples of your CD on Joe’s Jukebox ®.
16.Registered
marks, trademarks, patents, trade secrets, copyright and intellectual
property rights in Joe’s Jukebox ® belong to the Society and you must
not use them without the Society’s prior express written permission.

You do not have the right to reproduce, distribute, modify,
translate, publish, broadcast, transmit, perform, display, or sell any
content appearing on or in Joe’s Jukebox ®
17.Any data you
provide to the Society will be used only for the purposes for which you
provided it and it will not be passed on to any third party unless you
have expressly authorised the Society to do so or have consented to the
Society doing so and the Society will retain it for only as long as it
is necessary and reasonable for the Society to do so.
18.If any
of these conditions is held by any Court to be void invalid unlawful or
ineffective or partially ineffective the said condition shall be deemed
to have been severed from these conditions and the remainder of these
conditions shall continue to remain in force.
19.The provisions of the Contracts (Rights of Third Parties) Act 1999
shall not apply to these conditions.
20.The law covering these conditions shall be that covering England and
Wales.
